Are There Vultures Looking for Luxury Real Estate?!?!

According to an article found on CNNMoney.com, George Graham, former director of Fortress, a hedge fund, partnered up with one of the auction houses that works closely with Sotheby's International Realty and several other auction houses to sell Luxury Real Estate. Concierge Auctions was formed.

Concierge Auctions' goal appears to be to take advantage of the failing real estate market and auction off luxury real estate. They tell luxury homeowners that their home won't sell via a traditional real estate market for years so it is better to auction off their home and make something off of it instead of ending up in foreclosure. They are also hoping to get in with banks all across the country. Since many luxury homeowners are unable to handle the mortgage, the property is entering foreclosure. The lenders are then stuck with homes that they are often unable to sell for market value. By getting in with the lenders, Concierge hopes to auction off these homes and make a cut of the final sales price. Change you can believe in

Dear Employees:

           As the CEO of this organization, I have resigned myself to the fact that Barrack Obama is our President and that our taxes and government fees will increase in a BIG way. To compensate for these increases, our prices would have to increase by about 10%.  But since we cannot increase our prices right now due to the dismal state of the economy, we will have to lay off sixty of our employees instead. This has really been bothering me, since I believe we are family here and I didn't know how to choose who would have to go.

            So, this is what I did. I walked through our parking lots and found sixty 'Obama' bumper stickers on our employees' cars and have decided these folks will be the ones to let go. I can't think of a more fair way to approach  this problem.. They voted for change, they should get it.

            I will see the rest of you at the annual company picnic.

Land Surveys

When a land surveyor is hired to perform a survey, he will do several things. One of the first things he will do is research, through several sources including the County Clerk’s office, in order to gather information about anything that affects the property and its boundaries. The surveyor will then perform a field survey of the property. He will find any physical evidence that will affect the boundaries as well as note any improvements made. After all this has been done, the surveyor will determine where the property lines are based on his research and data. He will then put the data into the computer to verify and draw a plat.

There are various types of surveys that can be performed.
A boundary survey is simply for the purpose of locating the boundaries and corners of a piece of land.
A topographical survey is used to locate elevations, land contours, streams, fences, etc.
A subdivision survey divides the land into smaller pieces with their boundaries.
A mortgage location survey must meed the requirements for title insurance.

How Do I Handle an Insurance Claim on my Homeowner's Policy? Many times homeowner's find that insurance adjusters can't answer questions about their policy. Protect Your Home Value During Tough Economic Times

During today's tough economic times, we constantly hear abour the suffering housing market. Keep the following tips in mind to help protect the value of your home.

  • Mow your yard.
  • Mow your neighbor's yard.
  • Keep your house painted.
  • Support your homeowner's association. This is not the time to be quibbling over inconsequential matters.
  • Watch your entry to the neighborhood. Keep it well maintained.
  • Exterior matters most- many owners will be facing difficulty finding the funds to maintain their home as they have in the past. Don't put home maintenance issues off or you might find a bigger problem with a bigger bill later. Hire home professionals if necessary.
  • Don't flood the market if you are not a necessary seller. Your presence as a home for sale (if it competes with another house in the neighborhood) could cause a seller who is desperate to sell to become more desperate and drop their price further to compete.
  • Variety of selection is important.
  • Talk up the neighborhood! What you say to your friends is as important as any house advertisement.

New Info on Buyer's Tax Credit!

Many first-time home buyers that took advantage of the $8000 tax credit a year ago are still waiting for their refund. Most of these buyers amended their 2008 tax returns. The IRS says that all amended returns are reviewed by hand, therefore it is taking longer than normal.

BA Planning Board Approves Rezoning Request

FlightSafety, a Broken Arrow manufacturing company requested that land on the Southwest corner of 71st and Lynn Lane, where water towers currently sit, be rezoned to light industrial.
Broken Arrow Planning Board has approved the request, however, the City Council will consider the request on December 15, 2009

FlightSafety, owned by Berkshire Hathaway of New York , manufactures flight-simulation machines for commercial and military airlines. Currently, they are located at 2700 N. Hemlock Circle and employ 687 people. They plan to build a new facility and increase their employees to 1000.

BA residents are concerned about noise, traffic, childrens safety, and how the property would be financed.

When building a new home, there are so many decisions to make, from the location and builder to which carpet and paint to choose. Keep the following tips in mind when you decide to build a new home.
  • Location- Work with your Realtor when purchasing land and building your home to make sure that the location you desire will fit your budget as well as the style and size you want in your home. Don't find out after purchasing that you can't do what you want or that the market will not handle your specific plans.
  • Building- Select your builder carefully! Ask for recommendations from your Realtor, after all they work with builders everyday. Ask builders for referrals and contact them. Ask plenty of questions and don't be afraid to get more than one quote!
  • Products- Once you have purchased land, selected a builder, and begun the building process, there will be many products to choose. Ask about your options and shop around in advance to make sure you get what you want at the price you want. When selecting roofing products and styles- keep in mind your budget, style of home, and the weather in your area. Remember that by adding ridge vents or using certain materials you can decrease your energy costs. When selecting flooring products- remember to check wear, stain resistance, and even product type (such as carpet, tile, or hardwood).
  • Mortgage Options- Check with your mortgage banker to find out what mortgage options are available to you. For example, can you qualify for a VA or Rural Home Loan? Also, make sure you know your budget and how much down-payment you have. If you have less than 20% to put down, ask about loans that require less down-payment!

The Top Questions You Should Ask Your Mortgage Banker!

Most home buyer's have questions about their mortgage and the mortgage process. It is easy to get overwhelmed with the process so keep this list handy to get you started:

  • How much down-payment do I need to buy a house? If you are a Veteran or buying in a rural area you can get 100% financing. The seller is also allowed to pay your closing costs. If you are Native American you may be eligible for a Hud 184 loan. This loan requires as low as a 1.25% down-payment, depending on the loan amount. For an FHA loan, you must put down 3.5%, for Conventional a 5% down-payment is required, and Investment loans require a 20% down-payment.
  • What are Points/Origination Fees? Points and Origination Fees are additional fees paid at closing to lower your interest rate. 1 point is equal to $1000.
  • How do I find out exactly what my closing costs, fees, and other items are when I am comparing mortgage companies and rates? Ask for a Good Faith Estimate. Look at fee lines 800-900. Compare the rate, points/origination fees, and other items within that range.
  • What constitutes a rural development loan? A rural development loan is all based on the population of an area. Owasso and Glenpool, for example, are still rural and are eligible for a rural development loan. USDA Rural Development website can give you more information about any areas you are interested in.
  • How do Mortgage Bankers get paid? Generally, it is based on a commission calculated from the volume produced. The more produced, the higher percentage.

Mold! What Do I Do?

Mold is a problem that we hear about often. It is also something that causes great concern when it is found in our home or workplace. Because of potential health issues, it must be taken care of quickly. At what point, however, do you know when it becomes a legal issue and a lawsuit might be appropriate? Keep these things in mind before you contact an attorney:
  • Make sure that you inform your landlord or employer about the problem. Remember to keep proof that your landlord or employer received the information. Many times, your landlord or employer might not be aware of the problem, which can often be repaired at little cost. Make sure that you give them plenty of time to repair the problem as well. As the property owner, your insurance policy might cover the repairs. Contact your insurance agent to find out.
  • Finally, if you suspect health problems as a result of the mold, see your physician. Don’t let health problems linger and potentially get worse.

Improve Your Home or Move?

Right now, during these difficult economic times, many homeowners are choosing to improve their home rather than move. By doing so, when the economy changes they will have increased the value of their home and will be able to sell it at that point. There are many ways to improve your home and add value, including: repairing and replacing your roof, repainting the interior and exterior of your home, installing energy efficient products, providing curb appeal through landscaping, upgrading fixtures, and doing basic maintenance and pest control.

  • Upgrading Fixtures- this is an easy and often inexpensive way to improve your home. Replace doorknobs, cabinet pulls, light fixtures, and plumbing fixtures for newer ones.
  • Doing Basic Maintenance and Pest Control- this is one of the best ways to improve your property and prevent buyers from walking out the door. Many buyers simply don't want a "fixer upper" or problems with pests. They want it move in ready. Simple home maintenance and pest control will keep buyers interested and will help prevent more expensive repairs later.

Tulsa County Assessor Responds on Broken Arrow School Bond Election

Ken Yazel, Tulsa County Assessor, responds to The Future of Real Estate interview with Joe Cook who speaking for the passage of the Broken Arrow School Bond issue. Mr. Yazel that Tulsa County residents are, by far, the highest taxed real estate owners in the state.  Some proponents for the bond issue are saying that Yazel's weighted average is not representative of the actual tax rate property owners are paying.  Yazel responds "The fact is that Tulsa property owners are the highest taxed in the state and they deserve to know the truth.  I am not here to kill any bond issue or to oppose the vote.  I am here to make the facts available and make sure taxpayers are not mislead by marketing campaigns trying to get their votes."

Buy Now or Wait for Lower Rates?

With memories of home mortgage rates of 16% and 18% in years past, current mortgage interest rates are at some of the lowest points in the last 25 or 30 years. At this time, mortgage interest rates are in the 5% range, depending on the type of loan obtained. For most "First Time Home Buyers," the interest rates have probably never been lower in their lifetime. Even for seasoned home buyers, current interest rates are a real bargain! Waiting for a possible drop of perhaps 1/4% of mortgage rate does not justify waiting to purchase a home when the mortgage interest rate could just as easily go up 1/4% to 1/2%. If a home purchase is a consideration, taking advantage of the current interest rates would be a wise course of action.

    Preparing Your Landscaping For Cold Weather

    When the temperature drops and cold weather months arrive, it is important to remember that our landscaping still needs attention. There are many things that we can do to prepare our landscape for the cold weather. Here are just a few:

    • Prune- it is helpful to prune some varieties of plants during the Fall and Winter months.
    • Plant- check out plant and vegetable varieties that can be planted during the cold months.
    • Mulch- remember to keep about 3 inches of mulch on your flowerbeds all year long. Mulch can help keep the roots warm and hold in moisture.
    • Container Plants- don't forget container plants. Some work well inside during cold weather and some can re-grow simply by taking a cutting of the plant.

    Petition to Partition

    Many times, people will purchase a property with a friend or family member, only to find that years later a strain happens in the relationship and one or both parties want to sell their share in the property. That in itself is not a big problem unless the parties disagree about what should happen with the property. When a disagreement happens that can't be resolved, each party will need to seek an attorney. Usually, it will end up before a judge. Each party will lay out their interest for the property and the judge will determine what will happen with the property, including the interest each party will have with the property. The judge can also appoint appraisers to determine the property value. Getting to this point will usually cost quite a bit of money in legal fees.     Homebuyer's Tax Credit Extended

    The $8000 tax credit for first time home buyer's has been extended. Originally, the tax credit was only offered until November 30, 2009. The new tax credit extension enables home buyers under contract by April 30, 2010 to use the tax credit. The extension also allows for a $6500 tax credit for home buyers who have owned a home and lived in it for 5 years. In addition, home buyers have an additional 60 days to close the sale.     Why Do I Need a Survey When I Build a New Home or Addition?

    When you decide to build an addition or a new home, you will need a survey. A survey shows where the property lines are as well as any buildings, easements, driveways, or encroachments on the property, such as a neighbor's driveway. You might say, "I don't need a survey. I have a plat map". A plat map only shows the property boundaries. It doesn't show easements or encroachments which can cause a problem with a legal title. A survey will ensure that anything you are building is not on someoone else's property or easement. It will also help if you have acreage and decide to sell some of it later.

    Incorporating Green Ideas into Your Home

    When building, remodeling or replacing things in your home, eco-friendly or greeen ideas can be very easy and often inexpensive to implement. Here are some easy ways to incorporate green products into your property:

    Tulsa Oklahoma Moving Companies Face New Regulations

    Mike Ellingson, owner of Relocation LLC, says local movers in Oklahoma will be facing new rules from the Oklahoma Corporation Commission requiring insurance coverage and licensing.  Formerly, an inter-city mover was exempt from licensing and insurance laws but will now face penalties and fines for not holding these policies and coverages.  The law takes effect November 1st, 2009.  Homeowners are often deceived by companies who present a low bid but offer no coverages for damage or loss.  Research carefully before you hire a mover and trust them with all of your belongings.

    Tips for a Smooth Closing

    Buying and Selling a home can be a stressful process, but when the closing process doesn't happen smoothly, it can add even more stress. Here are a few tips to de-stress the closing process. First, listen to the professionals. If your real estate agent or mortgage broker gives you suggestions for the closing and moving process, heed their advice. They see problems regularly and can help you avoid some of the most common problems. Second, pack and move out of the house as early in the day, or even the night before, as possible and schedule closing for the afternoon. For buyers, schedule the final walk through earlier in the day as well. This added time should help with any unplanned delays. Third, consider adding a little extra expense to your budget in case there is a delay in closing and storage or hotel costs are needed or you need to hire a professional for an unexpected home repair. Finally, ask for a final settlement statement a day or two in advance of closing so that last minute surprises are kept to a minimum.

    When purchasing insurance for your condominium, there are some important things to keep in mind. First, know your covenants and bylaws. Each condo association is different and has different covenants and bylaws. With some, if the condo is destroyed, they will rebuild the outside, but the owner is responsible for everything from the sheetrock in.     Moving with Pets

    Moving can be very stressful for the homeowners and can be just as stressful on their pets. Here are some tips that can make that transition easier on you and your pet. First, keep your pet's routine as normal as possible during the packing and moving process. Second, if possible, have a friend or boarding service watch him.     Congressman John Sullivan Describes Obamacare

    Congressman Sullivan meets with constituents at the Summit Club in Tulsa, OK to bring an update on Congressional bills and helth care.

    The Obama administration has appointed 44 Czars whereas Clinton, Bush I and II, and Reagan averaged three and four czars during their terms.  Sullivan spoke in support of natural gas as a fuel source stating that the United States has a 120 year supply of natural gas.

    Another topic of discussion was the Fair Tax.  Sullivan was an original co-sponsor of the Fair Tax bill.  He expects the next 5-10 years will possibly produce a substantial change in our tax system.  Due, in part, to the enormous grass roots movement for this change.

    You have the right to dispute the amount your property is assessed for
    and it is pretty easy to do. If you saw my last TV show, I went
    through the process at the Assessor's office. Don't be intimidated.
    It is a rather simple process and the Assessor's office encourages
    taxpayers to file an assessment protest if they feel their taxable
    value is out of line with the market value of the property.

    The key is to present other properties that show your house could not
    sell for the value they have assessed it at. Make special note of any

    New Appraisal Rules Come With Costs

    How about this scenario the next time you refinance or apply for a new mortgage: The real estate appraisal that used to cost you $325 now costs $450, even though the appraiser doing the work is getting only $175 or $200.
    Plus, your appraisal-related charges may now be subject to add-on fees that you have never heard of -- $50 to $100 extra in "no show" penalties if you get stuck in traffic and miss your appointment with the appraiser. Or an extra $50 to $150 if the property is worth more than $500,000.
    On top of all this, your mortgage loan officer requires you to pay for the appraisal upfront with a credit or debit card, rather than including the fee with the usual lender origination costs at settlement. In some cases, your card may be charged more than the anticipated cost of the appraisal -- leaving debit-card holders in a potential overdraft situation.
    Worse yet, the person conducting your appraisal may be new to the field -- willing to work for a cut rate -- and may not be as familiar with local value trends and pricing adjustments as an appraiser with more experience. If your mortgage application is denied by one lender, you could be forced to pay for a second full appraisal because the new lender may not accept the first one.
    That scenario is now reality, according to critics of the new appraisal rules imposed nationwide on May 1 by Fannie Mae and Freddie Mac. Advocates of the rules vigorously deny that the new system is flawed and say any increase in appraisal costs should be manageable for most consumers.
    The rules, which go by the name Home Valuation Code of Conduct, are intended to improve the accuracy of appraisals by eliminating pressure on appraisers from loan officers. The code pushes most large lenders to use third-party "appraisal management companies" that contract with networks of independent appraisers around the country who have no direct contact with retail loan officers or mortgage brokers.
    Mortgage brokers -- who formerly chose appraisers and kept a competitive eye on appraisal fees -- claim that Fannie's and Freddie's rules are adding 20 percent to 30 percent to consumers' appraisal costs. Jeffrey T. Hawk, vice president of Maryland Mutual Mortgage in Forest Hill, Md., north of Baltimore, said a standard appraisal that previously went for $325 jumped to $400 or more May 1 when he began using management company appraisers.
    Some applicants also are balking at handing over credit card information upfront when they're not completely sure what the charge will be. "I lost three clients the first week" because of the credit card requirement, Hawk said.
    Buddy McCombs, senior vice president of EverBank, a Jacksonville, Fla., lender that buys loans originated by Hawk's firm and now contracts with management companies for appraisals, conceded "there's probably a little increased cost" with the new system, "but I don't think it's devastating."
    "What's terrible is what's happening to [long-established] appraisers who won't work for the low fees," said James Facchini of American Pacific Appraisal in Sacramento. "On May 1, I lost almost my entire customer base" -- mortgage brokers who now can't pick up a phone and order an appraisal from him.
    Instead Facchini and other appraisers either have to sign up with management companies or find other employment. What "really bothers me is that the consumer has no idea what's going on," Facchini said. After he signed up with one management company, he said, two borrowers commented to him after he finished his appraisal, "Wow, you really charge a lot."
    They were each being hit with $550 appraisal fees, while he was getting just $250 through the management company. As he sees it, that leaves $300 of "slush" somewhere in the process -- some going to the management company, but the rest probably "flowing to the lender for doing absolutely nothing."
    Rich Kuegler, a vice president at MDA Lending Solutions, a national appraisal management company, said payments to firms such as his are compensation for creating, managing and reviewing a network of thousands of appraisers -- MDA has 9,000 under contract across the country -- and for the "processing and administrative" costs that have been taken off the backs of brokers and lenders.
    As to appraisers' complaints about fees, Kuegler said, "we offer the ability to have a steady stream of work, training and support." In other words, appraisers can expect to make up in volume what they're sacrificing per assignment. (Kuegler has also invented a 36 hour day, never knew that Lincoln freed the slaves, and his business plan is modeled after southern plantations)

    Who am I?

    This poem was read on my radio program during and interview with Ronda
    Robertson. The poem was written by a boy from the Tulsa Boys' home.


    Who Am I?


    I'm the boy who got up early one morning

    and found my mother's body stiff and cold.

    I'm the boy who had to eat from the trash dumpster

    My mom will come for me soon.

    I'm the boy who lost my parents, but I got substitute parents

    It's not all bad I can still see out of my right eye.

    I'm the boy that my uncle taught to be a girl

    The tears will heal and the taste will dissipate.

    Who am I?

    I'm the boy that cries at night

    Someday the loneliness will end.

    I'm the boy that people say is really ugly,

    But when I get big people will stop making fun of me.

    I'm the boy who was left to care for my brother and sister

    She came back 6 months later.

    I'm the boy he used for an ashtray

    The scars are not too bad.

    Volunteers Needed: 2009 Bixby BBQ'n Music Festival!!!


    The Rotary Club will be raising about 75k to put back into the community helping feed the poor, provide college scholarships, supporing you programs. The BBQ Festival is this Friday (5 to 11pm) and Saturday (9am till 11pm). I am in charge of volunteers and am still needing some dependable, honest, people to help on Saturday evening. Below are the the shifts I need filled. We have over 90 BBQ Teams coming and have the best music ever, so please help us help others by donating a couple hours or your time.     Selling Your Home is a Price War, Not a Beauty Contest

    Many home sellers are learning the important trends which affect the real estate markets.  Market pressures from bank-owned home sales where banks are eager to drop prices in order to move the house off the company books, has created a new bread of home buyer who are more detached from the emotions of the home purchse.
     
    In many cases (not all), I have given advice to be more price competitive rather than condition competitive.  The pocket of the market your home falls into is a critical factor in how you should plan to market your home but need less to say, the demands by home buyers have changed courses and left traditional advice off the track.  Make sure you enter the home selling market fully prepared before you use old advice expecting successful results in a new market.

    International Tales of Real Estate Sing Same Tune

    I visited with Andreas.. Demetriou of World Properties and Investments of Athens, Greece at the Who's Who in Luxury Real Estate said the real estate market in Greece slowed in June of 2008 - the same story as the United States markets. Many international buyers with money have taken advantage of the low property values in Greece, he said. It is pretty amazing how the economy has become so global in such aa relatively short period of time. Tulsa, Oklahoma's luxury home market has seen a similar trend as sales for area home over one million dollars is up from the same period in 2008.
